The evidence

• “Keep was chosen, by the overwhelming majority of 6,483 votes. On the 14th of July, 1858, Judge Keep tendered his resignation, to take effect on the 17th of August; and, on the 27th of July, David Noggle was appointed to fill the vacancy. Judge Keep was, however, a candidate at the ensuing election, held April 5, 1859, and was defeated by Judge David Noggle, who received a majority of 3,693 votes.”
