The evidence

• “An act was passed to provide for the election of a State prison commissioner by the legislature at that session — ^to hold his office until the first day of the ensuing January. The office was then to be filled by popular vote at the general election in November, 1853 — and afterwards biennially — the term of office to be two years from the first day of January next succeeding the election by the people. On the 28th of March, the legislature, in joint convention, elected John Taylor to that office.”
