The railroad company commenced work on the road toward Janesville, after clearing the indebtedness of the old company.

The evidence

• “This company, however, at last was compelled to suspend work on the road, and finally went into bankruptcy. The present company having closed up and satisfactorily arranged the entire indebtedness of the old company, so as to clear it from all and every incumbrance, have now (the fall of 1855) commenced work on the road with every prospect of a speedy completion of it to Janesville, where it will beyond a doubt be running in the spring of 1856.”
